These terms apply to your use of undercastleaudio.com and to the audio plugins sold here, including Lost At Sea. Under Castle Audio is the trading name of Devin Castle, a sole proprietor based in Arkansas, United States ("Under Castle Audio", "we", "us"). When you use this site or buy a plugin, you're agreeing to these terms with us.

Who processes your order

You buy directly from Under Castle Audio. Our checkout and payments are run by Wix and its payment providers. Prices are shown in US dollars, and any sales tax that applies is added at checkout.

Accepting these terms

By using this site, buying a plugin or using one of our plugins, you agree to these terms. If you don't agree, please don't use the site or the plugins.

Your license

When you buy a plugin, you get a personal, non-exclusive, non-transferable license to use it. The license doesn't expire. In particular:

• Each license key can be activated on up to 3 computers at a time. You can deactivate a computer from inside the plugin to move your license to another one.
• You can use the plugin in your own music and audio, including commercial releases, film, games and client work. You don't owe us anything further for what you create with it.
• The plugin needs an internet connection to activate, and checks in occasionally after that. It keeps working offline for up to 30 days between checks.
• You may not share, resell, rent or give away your license key or the plugin files, or let other people use your activations.
• You may not copy, decompile, reverse engineer or modify the plugin, or try to get around its license check, except where the law gives you a right to do so.

Ownership

Under Castle Audio keeps all rights in the plugins, their code, artwork, sounds, names and logos, and in the content of this site. Buying a plugin gives you a license to use it, not ownership of it.

Acceptable use

You agree not to use this site or our plugins:

• for anything unlawful;
• for fraud, spam or misleading activity;
• to infringe anyone's intellectual property or other rights;
• to interfere with the security or operation of the site, the plugins or our licensing service.

Updates and support

We may release updates and fixes. We aim to keep the plugins working well, but we can't promise that they'll be uninterrupted, error-free or compatible with every computer, operating system or music app. Please try the audio demo and check the system requirements before you buy.

Suspending or ending a license

We may suspend or end a license if you seriously break these terms, if a payment is reversed or not completed, if we see a security or fraud risk, or if you repeatedly break these terms. If your purchase is refunded, its license key is deactivated.

Liability

The plugins and this site are provided "as is". To the extent the law allows, we aren't liable for indirect or consequential losses, or for loss of data, projects or profits, and our total liability to you is limited to the amount you paid for the plugin concerned. Nothing in these terms limits any rights you have under consumer law that can't be excluded.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. The terms in place when you bought a plugin continue to apply to that purchase.

Governing law

These terms are governed by the laws of the State of Arkansas, United States, except where your local consumer law gives you rights that can't be excluded.
